Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of AirRoster, operated by AirRoster Pty Ltd ("we", "us", "our"). By creating an account or using AirRoster in any way, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must not use AirRoster.

2. Description of Service

AirRoster is a software-as-a-service (SaaS) platform for aircraft syndicate management, including features for bookings, digital logbooks, pilot currency tracking, maintenance scheduling, expense splitting, and weather information. The service is provided on a subscription basis.

3. Accounts & Registration

• You must be at least 18 years of age to create an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must provide accurate and complete information during registration and keep it updated.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately at hello@airroster.com.au if you suspect unauthorised access to your account.

4. Subscriptions & Billing

• AirRoster is offered on annual subscription plans. Pricing is displayed on our Pricing page.
• All plans include a 30-day free trial. No credit card is required to start a trial.
• After the trial, a valid payment method is required to continue using paid features.
• Subscriptions automatically renew annually unless cancelled before the renewal date.
• Prices are in Australian Dollars (AUD) and include GST where applicable.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

5. Cancellation & Refunds

You may cancel your subscription at any time from your account settings. Upon cancellation:

• Your access continues until the end of the current billing period.
• No refunds are provided for the unused portion of a subscription period, except where required by Australian Consumer Law.
• Your data will be retained for 90 days after cancellation, during which you may export it. After 90 days, data is permanently deleted.

6. Acceptable Use

You agree not to:

• Use AirRoster for any unlawful purpose or in violation of any applicable laws or regulations.
• Attempt to gain unauthorised access to any part of the service or other users' accounts.
• Upload malicious code, viruses, or any content that is harmful, offensive, or violates third-party rights.
• Reverse engineer, decompile, or attempt to extract the source code of AirRoster.
• Resell, sublicense, or otherwise commercialise access to the service without our written consent.
• Use the service to store false or misleading aviation records.

7. Intellectual Property

AirRoster and all associated software, design, trademarks, and content are owned by or licensed to AirRoster Pty Ltd. Nothing in these Terms grants you ownership of or a licence to our intellectual property beyond the limited right to use the service as intended.

You retain ownership of all data you input into AirRoster (your logbook entries, flight records, etc.). You grant us a limited licence to store and process that data solely for the purpose of providing the service.

8. Availability & Modifications

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend, or discontinue features of AirRoster at any time, with reasonable notice where material changes are made.

Scheduled maintenance will be announced in advance where possible. We are not liable for service interruptions caused by events outside our reasonable control.

9. Limitation of Liability

To the maximum extent permitted by Australian law, AirRoster Pty Ltd is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the service.

Our total liability to you for any claim arising out of or relating to these Terms or the service is limited to the amounts you paid us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded under the Australian Consumer Law, including consumer guarantees.

10. Governing Law

These Terms are governed by the laws of the State of Victoria, Australia. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.
